We have seen numerous claims for injuries sustained in motor vehicle accidents involving company vehicles driven by employees after hours. An employer may ask an employee to pick up or deliver merchandise on the way to or from home, and provide a company car, van or truck for the trip. Sometimes the employee, while on the way to perform the task, makes a stop at a store or establishment that may not be considered a “deviation from employment” by the Workers Compensation Board. Perhaps the employee was picking up dinner on the way home in the evening or dropping off clothes at the dry cleaners the next morning on the way to work. There are many “gray areas” relating to deviation, all of which are subject to interpretation by the WCB. You should advise your employees of their responsibilities when they use a company vehicle. Tell them about any restriction on their use of the vehicle – for instance, that usage is limited to working hours only.
